By accessing or using RealPropertiesAI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
RealPropertiesAI provides AI-powered tools to generate real estate listing descriptions, social media content, email campaigns, and video scripts. The Service is provided "as is" and "as available".
3. User Accounts
- You must provide accurate account information
- You are responsible for maintaining the security of your account
- You must notify us immediately of any unauthorized use
- One account per person; accounts cannot be shared
4. Acceptable Use
You agree NOT to use the Service to:
- Generate content that violates fair housing laws
- Create fraudulent, misleading, or deceptive listings
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Attempt to reverse engineer or exploit the Service
- Use automated tools to access the Service (except via our API)
5. Generated Content
Your Responsibility: You are solely responsible for reviewing, editing, and ensuring the accuracy of all AI-generated content before publishing. The Service may produce errors, inaccuracies, or inappropriate content.
Ownership: You retain ownership of the content generated using your property data. We retain no rights to your generated content.
Disclaimer: We do not guarantee that generated content is accurate, complete, MLS-compliant, or suitable for any particular purpose.
6. Billing and Payments
- Paid subscriptions are billed monthly via Stripe
- Prices are in USD and subject to change with notice
- Usage limits reset at each billing period; unused credits do not roll over
- You can cancel anytime; access continues until period end
- Refunds are available within 7 days of first payment
7. Intellectual Property
The Service, including its design, features, and underlying technology, is owned by RealPropertiesAI and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without permission.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RealPropertiesAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Indemnification
You agree to indemnify and hold harmless RealPropertiesAI from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.
11. Termination
We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may delete your account at any time through the app settings.
12. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
